DISTANCE SERVICE AGREEMENT AND REFUND POLICY

    Buyer (User / Subscriber):
    The natural or legal person who registers on the platform and benefits from the services.

    2. Subject of the Agreement

    This Agreement regulates the rights and obligations of the parties regarding the subscription-based provision of e-commerce logistics management software, warehouse management, order management, e-invoice, fulfillment, and related digital services offered through the APPIA platform.

    This Agreement has been prepared in accordance with the Law No. 6502 on Consumer Protection, the Regulation on Distance Contracts, and relevant legislation.

    3. Services and Subscription Packages

    APPIA offers the following basic service packages:

    • Basic Package: Order & shipping management, stock management, e-invoice, basic accounting
    • Professional Package: Basic package scope + fulfillment, 3D warehouse modeling, store performance
    • Enterprise Package: All features + priority support, private consulting, API access

    4. Conclusion of the Agreement

    The Agreement is deemed concluded when the user registers on the platform and pays the subscription fee or starts the free trial period. The user declares that they have read and accepted this agreement during registration.

    5. Payment Conditions

    • Subscription fees are collected in advance in the selected period (monthly/annually).
    • Payments are made through a secure payment infrastructure (Paddle or iyzico).
    • In case of cancellation of annual subscriptions, the refund policy applies to the remaining period.
    • Shipping services are billed based on usage and deducted from the APPIA wallet.
    • Invoices are sent to your registered email address.

    6. Right of Withdrawal

    6.1 Withdrawal for Digital Services:

    Pursuant to Law No. 6502 and the Regulation on Distance Contracts, the user cannot exercise the right of withdrawal in digital content and services if the user has explicitly consented to the initiation of the performance of the service. The user is deemed to have given consent within this scope by logging into the platform and starting to use the services.

    6.2 Refund and Cancellation Conditions:

    • Full refund is made for subscriptions that have not been used at all within the first 14 days.
    • An 80% refund is applied for usage not exceeding 30 days in an annual subscription.
    • No refund is made for usage exceeding 30 days; the subscription remains active until the end of the period.
    • If fulfillment and shipping services have been used, the amount corresponding to these services is excluded from the scope of refund.

    7. Cancellation Procedure

    You can submit your cancellation requests in the following ways:

    • In-platform: Account Settings > Subscription > Cancel
    • Phone: 0224 502 00 18 (weekdays 09:00-18:00)

    The cancellation request must be submitted before the end of the current period; otherwise, the fee for the next period will be charged.

    8. Service Disruption and Liability

    APPIA undertakes to provide service with a 99.5% uptime target. Planned maintenance is notified in advance. For direct damages caused by service disruptions, a proportional part of the monthly subscription fee may be refunded as credit. APPIA cannot be held responsible for the user's earnings, data loss, or indirect damages.

    10. Governing Law and Jurisdiction

    The laws of the Republic of Turkey shall apply to this agreement. In case of disputes, Bursa Consumer Arbitration Committee and Bursa Courts are authorized. For EU users, the relevant EU data protection authority is authorized for disputes under GDPR.
